Terms of Use

Please read these Terms of Use (“Terms”) carefully before accessing or using The Mortgage LLM platform (the “Platform”), operated by Santhiar Group, Inc (“Santhiar,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Platform.
1. The Platform
The Platform is an AI-assisted information and decision-support tool for US housing finance. It provides (a) a natural-language interface for querying public mortgage data (the “Chat Interface”), and (b) pre-trained statistical scoring models for loan-level analytics (the “Scoring Models”), together with related documentation, benchmarks, and APIs. The Platform draws on publicly-disclosed data sources including the Home Mortgage Disclosure Act (HMDA) database, Fannie Mae and Freddie Mac loan-level performance disclosures, and Ginnie Mae monthly loan-level disclosures.
2. The Platform Is Not Financial, Legal, or Compliance Advice
This is the most important section of these Terms.
The Platform is an informational and analytical tool. It is not a substitute for licensed mortgage origination, underwriting, legal counsel, compliance review, fair-lending examination, securities analysis, financial planning, or any other regulated professional service. Outputs from the Platform — whether produced by the Chat Interface, the Scoring Models, or any benchmark or API — are statistical and informational only. They do not constitute, and must not be relied upon as:
- An adverse-action notice or reason for credit denial under the Equal Credit Opportunity Act (ECOA), Regulation B, or any comparable state law;
- A determination of mortgage loan eligibility, qualification, pricing, or rate-spread classification;
- A regulatory finding regarding Higher-Priced Mortgage Loan (HPML) status, HOEPA coverage, Ability-to-Repay (ATR), Qualified Mortgage (QM), or any other Reg Z or Reg X provision;
- A fair-lending examination, disparate-impact finding, or conclusion of compliance with HMDA, ECOA, FHA, the Community Reinvestment Act (CRA), or any other consumer-protection statute;
- A representation or warranty regarding the credit quality, performance probability, prepayment behavior, repurchase risk, or saleability of any specific loan;
- A valuation, mark, or measure of mortgage servicing rights (MSR), mortgage-backed securities, or any other financial asset;
- Tax, accounting, securities, investment, or fiduciary advice.
You are solely responsible for any decision made or action taken based on Platform output. Lending, underwriting, compliance, pricing, securitization, and reserve-setting decisions must be made by qualified professionals using their own judgment, applicable law, internal policy, and independent verification of the underlying data. Where the Platform output references statutes, regulations, agency guidance, or industry standards, those references are provided for general orientation only and are not legal opinions.
3. Limitations of AI-Generated Output
Outputs produced by the Chat Interface are generated by large language models and can contain errors, including but not limited to: factual inaccuracies; outdated information; hallucinated citations, statistics, or regulatory references; misinterpretation of user questions; and inconsistencies across sessions. The Scoring Models are statistical predictions calibrated against historical data; they may not reflect current market conditions, regulatory changes, or loan-specific characteristics outside the training distribution.
Before relying on any Platform output for a material decision, you must independently verify the underlying data and conclusions through primary regulatory sources (e.g., the CFPB, FFIEC, Fannie Mae, Freddie Mac, Ginnie Mae, HUD, the FHFA), authoritative industry references, and qualified human review.
4. Eligibility and Accounts
You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction. The Platform is intended for mortgage-industry professionals, researchers, regulators, and adult members of the public with a legitimate interest in US housing-finance information. By using the Platform you represent that you meet these criteria.
Some features require authentication through Google or Microsoft. You are responsible for maintaining the confidentiality of any third-party credentials used to access the Platform and for all activity that occurs under your account.
5. Permitted Use
Subject to these Terms, Santhiar grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business or personal research, education, market intelligence, and analytical purposes, including (without limitation) pre-funding screening, post-funding quality control, MSR valuation support, channel-routing analysis, and fair-lending self-assessment — in each case as inputs to your own qualified-professional review process, not as substitutes for it.
6. Prohibited Use
You agree not to:
- Use the Platform as the sole or primary basis for any credit-decision, adverse-action notice, or loan-eligibility determination;
- Misrepresent Platform output as a regulated financial, legal, tax, or compliance opinion;
- Use the Platform to violate any applicable law, including ECOA, the Fair Housing Act, RESPA, TILA, the Gramm-Leach-Bliley Act, or any state consumer-protection statute;
- Submit any information that is unlawful, defamatory, infringing, or in violation of a third party’s rights;
- Submit non-public personal information (NPI) about specific identified consumers, including borrowers’ full names paired with Social Security numbers, account numbers, or other sensitive identifiers, unless you have a lawful basis to do so and accept full responsibility under applicable privacy law;
- Scrape, crawl, or use automated means to extract data from the Platform beyond the rate limits and API patterns documented in the User Guide;
- Resell, sublicense, redistribute, or build a competing product on top of the Platform’s outputs, models, benchmarks, or underlying compiled datasets;
- Reverse engineer, decompile, or attempt to extract the source code, model weights, or training data of any Platform component;
- Circumvent or attempt to circumvent rate limits, authentication, tier enforcement, or any other technical or operational control;
- Use the Platform to develop or train any product, model, or dataset that is competitive with the Platform.
7. User Submissions
You retain ownership of the questions, loan-feature payloads, free-text inputs, and other material you submit to the Platform (collectively, “Submissions”). You grant Santhiar a non-exclusive, worldwide, royalty-free license to use, copy, store, and process your Submissions to operate and improve the Platform, to monitor for abuse and quality assurance, and to comply with legal obligations. Aggregated, de-identified statistics derived from Submissions may be used to improve the Platform’s models, benchmarks, and documentation.
Do not submit any Submission that you do not have the right to submit, or that you would not want logged, processed by automated systems, or used to compute aggregate analytics.
8. Intellectual Property
The Platform, including all software, models, model weights, trained artifacts, documentation, benchmarks, the “The Mortgage LLM” name and logo, and all other content other than Submissions, is owned by Santhiar or its licensors and is protected by US and international intellectual property laws. Public-data components (HMDA, GSE loan-level files, GNMA disclosures) remain subject to their respective publishers’ terms.
9. Third-Party Services
The Platform integrates with third-party services including Google Cloud (infrastructure), Anthropic (large language model APIs), Google Identity (sign-in), and Microsoft Entra ID (sign-in). Your use of those services is subject to their respective terms and privacy policies. Santhiar is not responsible for the availability or behavior of third-party services.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY. SANTHIAR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SANTHIAR DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY PLATFORM OUTPUT OR ANY UNDERLYING DATA.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SANTHIAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOAN-LEVEL LOSSES, REPURCHASE LIABILITY, REGULATORY FINES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SANTHIAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SANTHIAR’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SANTHIAR FOR ACCESS TO THE PLATFORM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Santhiar and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Platform, (b) your Submissions, (c) your violation of these Terms, (d) any decision you or your organization makes in reliance on Platform output, or (e) your violation of any third-party right, including without limitation any intellectual property or privacy right.
13. Suspension and Termination
Santhiar may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including (without limitation) suspected violation of these Terms, suspected misuse of the Platform, abuse of rate limits, or in response to any legal or regulatory request. You may stop using the Platform at any time. Sections 2, 3, 6, 8, 10, 11, 12, 14, and 15 will survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved by good-faith negotiation will be submitted to the exclusive jurisdiction of the state and federal courts located in Delaware. To the maximum extent permitted by law, you and Santhiar each waive any right to a jury trial.
15. Changes to These Terms
Santhiar may update these Terms from time to time. We will post the updated Terms at this URL and update the “Effective date” above. Your continued use of the Platform after the effective date of an updated Terms constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
